Rules on Final Pay and Certificate of Employment in the Philippines
Under DOLE Labor Advisory No. 06, Series of 2020, "Final Pay" represents the total sum of all wages, benefits, and monetary credits due to an employee upon separation or resignation from an establishment.
Mandatory 30-Day Release Timeline
DOLE Labor Advisory No. 06-20 explicitly mandates that final pay shall be released within thirty (30) days from the date of separation or termination of employment, unless a more favorable company policy, individual contract, or collective bargaining agreement (CBA) exists.
Core Components of Final Pay
- Unpaid Wages: Basic compensation and earned differentials for work days rendered in the last cut-off period.
- Pro-rated 13th-Month Pay: Calculated as one-twelfth of the total basic salary earned from January 1 (or date of hire) until the last day of employment, less any advances received (floored at zero).
- Service Incentive Leave (SIL) Cash Conversion: Unused SIL credits (minimum 5 days per year for employees with at least 1 year of service) converted to cash equivalent at the daily rate upon separation.
- Separation Pay: If applicable due to authorized causes (redundancy, retrenchment, installation of labor-saving devices, closure).
Worked Example
An employee earning ₱26,100.00 monthly under a 261-day factor resigns with:
- Daily Rate: (₱26,100.00 × 12) ÷ 261 = ₱1,200.00
- 5 unpaid days worked: 5 × ₱1,200.00 = ₱6,000.00
- YTD basic wages of ₱180,000.00 with 0 13th-month pay advance: ₱180,000.00 ÷ 12 = ₱15,000.00
- 5 days unused leave: 5 × ₱1,200.00 = ₱6,000.00
- Other earnings: ₱1,000.00; Deductions: ₱2,000.00
- Net Final Pay: ₱6,000 + ₱15,000 + ₱6,000 + ₱1,000 − ₱2,000 = ₱26,000.00.
